Please read these terms carefully before using our luxury car rental services. By using our services, you agree to be bound by these terms.

Welcome to Ocars. These Terms of Service ("Terms") govern your use of our luxury car rental services and website. These terms constitute a legally binding agreement between you and Ocars. Please read them carefully, as they contain important information about your rights and obligations, including limitations of liability and dispute resolution procedures. By submitting a rental request or using our services, you acknowledge that you have read, understood, and agree to these terms.

1. Acceptance of Terms

1.1 Agreement to Terms

By accessing our website, submitting a rental request, or using any of our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

1.2 Eligibility

To use our services, you must be at least 25 years old, hold a valid driver's license for at least 1 year, possess a valid credit card in your name, and meet all requirements specified in your rental agreement.

1.3 Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically.

2. Rental Request and Booking Process

2.1 Request Submission

When you submit a rental request through our website, you are making an inquiry for vehicle availability. This is not an automatic booking. Our rental manager will review your request and contact you to confirm availability, discuss requirements, and finalize the booking.

2.2 Booking Confirmation

A rental is confirmed only when you receive written confirmation from our rental manager via email. The confirmation will include vehicle details, rental period, pricing, pickup/drop-off arrangements, and terms specific to your rental. Payment is processed upon booking confirmation.

2.3 Accurate Information

You agree to provide accurate, complete, and current information when submitting requests and throughout the rental process. False or misleading information may result in booking cancellation without refund and may affect future rental eligibility.

2.4 Vehicle Availability

All vehicles are subject to availability. While we make every effort to fulfill your preferences, we cannot guarantee availability until confirmed by our manager. We reserve the right to offer alternative vehicles of similar or higher category if your first choice becomes unavailable.

3. Pricing and Payment

3.1 Rental Fees

Rental prices are quoted in Euros (€) and include full insurance with deductible, 24/7 roadside assistance, and standard mileage allowance as specified in your rental agreement. Prices may vary based on vehicle category, rental duration, season, location, and current demand.

3.2 Additional Charges

Additional fees may apply for: extra mileage beyond included allowance, delivery and collection outside standard areas (fees vary by vehicle and may be waived for some locations), one-way rentals between different locations (may be free under some circumstances, otherwise charged per km to return to base), late returns, fuel charges if not returned full, traffic violations, toll charges, and damages or cleaning fees. VAT/taxes are added during payment and are not included in displayed prices.

3.3 Security Deposit

A security deposit is required for all rentals and varies by vehicle. The deposit is pre-authorized on your credit card at pickup. The deposit may be used to cover fuel differences, exceeded mileage charges, traffic fines, toll charges, and can contribute towards the deductible if damage occurs. Your deposit is refunded within 14 days after vehicle return, minus any applicable deductions. Ocars processes payments and holds deposits directly for our customers, acting in your interest when dealing with car rentals. This provides additional security, protecting you from risks associated with rental companies that may misuse deposits.

3.4 Payment Methods

We accept major credit cards (Visa, Mastercard, American Express). Debit cards and cash are not accepted for security deposits. Payment is processed when booking is confirmed. All prices include applicable VAT. Additional local taxes may apply depending on rental location.

4. Insurance and Liability

4.1 Included Insurance

All rentals include full insurance with a deductible (also called excess). The deductible amount varies by vehicle. In case of damage or theft, you are only liable up to the deductible amount, not the full cost of damages. The deductible is your maximum financial responsibility. Full details including your specific deductible amount are provided in your rental agreement.

4.2 Coverage Details

All cars have the same full insurance with deductible. No premium coverage options are available. The deductible amount varies by vehicle and is your maximum financial responsibility for any damages.

4.3 Insurance Exclusions

Insurance does not cover: damages caused by driver negligence or violation of rental terms, unauthorized drivers, off-road use or racing, driving under influence of alcohol or drugs, damages to interior, wheels, or undercarriage, loss of keys or documents, misfueling (wrong fuel type), or violations of traffic laws.

4.4 Third-Party Liability

Third-party liability insurance is included as required by law in the rental country. This covers damages to third parties and their property. Coverage limits are specified in your rental agreement and meet legal minimum requirements.

5. Rental Terms and Conditions

5.1 Driver Requirements

Only authorized drivers listed in the rental agreement may operate the vehicle. All drivers must present valid documentation at pickup, meet age and license requirements, and be approved by Ocars. Unauthorized drivers will void insurance coverage and may result in immediate rental termination.

5.2 Vehicle Use

Vehicles must be used in accordance with manufacturer specifications and applicable laws. Prohibited uses include: racing, competitions, or testing; off-road driving; transporting illegal goods; subleasing or commercial use without authorization; transporting more passengers than seat belts; towing or pushing other vehicles; and use in prohibited countries without prior approval.

5.3 Geographic Restrictions

Cross-border travel is allowed with prior authorization. Any country or route requires approval from our team. There are no extra fees for approved cross-border travel. Unauthorized cross-border travel voids insurance and may result in immediate rental termination.

5.4 Mileage Limits

Rentals include a daily mileage allowance as specified in your agreement (typically 150-200 km/day, varies by vehicle). Each vehicle page clearly states the included km per day. Additional mileage is charged per kilometer as stated in your rental agreement and varies by vehicle. There are no unlimited mileage options. Mileage restrictions help maintain vehicle condition and ensure fair pricing.

5.5 Fuel Policy

Vehicles are provided with a full tank and must be returned with a full tank. Failure to refuel results in fuel charges at market rate plus a €50 service fee. You are responsible for fueling the car with the correct fuel type. For petrol cars, ensure at least 98 octane fuel is used. Misfueling costs are charged according to insurance policy—up to the deductible (excess) amount.

5.6 Vehicle Condition

You must inspect the vehicle at pickup and report any pre-existing damage. You are responsible for maintaining the vehicle in good condition, including regular fluid checks, tire pressure, and cleanliness. Return the vehicle in the same condition as received, allowing for normal wear and tear.

6. Cancellations, Modifications, and Returns

6.1 Cancellation Policy

Cancellations more than 48 hours before pickup receive a full refund. Cancellations between 24-48 hours before pickup incur a 50% charge. Cancellations less than 24 hours before pickup forfeit the full rental amount. No-shows result in full charge with no refund. Exceptions may be made for extraordinary circumstances at our discretion.

6.2 Modifications

Rental modifications (dates, vehicle, location) can be requested up to 24 hours before pickup, subject to availability and potential price differences. Contact your rental manager to discuss modifications. Some changes may incur additional fees or require a new booking.

6.3 Extensions

Rental extensions are possible subject to vehicle availability. Request extensions at least 24 hours before scheduled return by contacting your manager. Extension pricing will be confirmed before approval. Unauthorized extensions result in late return fees of €100/hour until the daily rental rate is reached.

6.4 Early Returns

Early returns do not qualify for refunds as the vehicle was reserved exclusively for your rental period. Contact your manager if you need to return early.

6.5 Late Returns

A 1-hour grace period is provided for returns. Beyond this, late fees of €100/hour apply until the daily rental rate is reached. Returns more than 3 hours late without approval may be reported as stolen. Unauthorized late returns may void insurance coverage for the extended period.

7. Damage, Accidents, and Theft

In case of accident or damage: (1) Stop immediately and ensure safety, (2) Call emergency services if needed (112 in Europe), (3) Contact our 24/7 hotline immediately, (4) Do not admit fault or liability, (5) Collect information from all parties and witnesses, (6) Take photos of damage and scene, (7) Obtain a police report if required. Failure to report accidents or damage may void insurance coverage. You remain liable for the deductible amount (your maximum responsibility). Hit-and-run incidents or theft must be reported to police and Ocars within 24 hours.

8. Traffic Violations and Fines

You are responsible for all traffic violations, parking tickets, toll charges, and congestion charges incurred during your rental. These will be charged to your credit card plus an administrative fee of €50 per incident. We cooperate with authorities in identifying drivers for violations. Serious violations may affect your eligibility for future rentals.

9. Roadside Assistance and Breakdowns

24/7 roadside assistance is included in all rentals. In case of breakdown or mechanical issue: call our emergency hotline immediately, do not attempt unauthorized repairs, and await assistance or further instructions. We will arrange towing and provide a replacement vehicle when possible. Breakdowns due to driver error (misfueling, negligence) are not covered and may incur charges.

10. Personal Belongings

We are not responsible for personal belongings left in vehicles or lost during your rental. Do not leave valuables in vehicles, especially when parked. Check for all belongings before returning the vehicle. Items found after return will be stored for 30 days; we may charge storage and shipping fees for item return.

11. Privacy and Data Protection

Your personal information is collected, used, and protected in accordance with our Privacy Policy and applicable data protection laws (including GDPR). By using our services, you consent to our data practices as described in our Privacy Policy. We may use GPS tracking in vehicles for security, fleet management, and customer support purposes.

12. Limitation of Liability

To the maximum extent permitted by law, Ocars and its affiliates are not liable for: indirect, incidental, or consequential damages; loss of profits or business opportunities; personal injury or death not caused by our negligence; damages from vehicle malfunction beyond our control; or delays, cancellations, or unavailability due to circumstances beyond our reasonable control. Our total liability for any claim is limited to the amount paid for the rental in question.

13. Force Majeure

We are not liable for failure to fulfill obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, government actions, pandemics, or other force majeure events. In such cases, we will work with you to reschedule or provide refunds when possible, but we do not guarantee availability or compensation.

14. Indemnification

You agree to indemnify and hold harmless Ocars, its employees, managers, and affiliates from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from: your use of the vehicle, violation of these terms, violation of applicable laws, damage or injury caused by you, or breach of your rental agreement.

15. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Ocars or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

16. Governing Law and Disputes

These terms are governed by the laws of Spain. Any disputes arising from these terms or your rental will be subject to the exclusive jurisdiction of the courts of Madrid, Spain. For consumer contracts within the EU, consumers may also be entitled to bring claims in their country of residence. We encourage resolving disputes amicably through our customer service before pursuing legal action.

17. Severability

If any provision of these terms is found to be invalid or unenforceable by a court, the remaining provisions will continue in full force and effect. Invalid provisions will be modified to the minimum extent necessary to make them valid while preserving the original intent.

18. Entire Agreement

These Terms of Service, together with your specific rental agreement, our Privacy Policy, and any additional terms communicated at booking, constitute the entire agreement between you and Ocars. These terms supersede any prior agreements, understandings, or representations. Your rental agreement may contain additional vehicle-specific terms.
